General Diagnostic Terms
and Conditions of Sale
(1) Introduction
Please read these terms of sale carefully.
You will be asked to expressly agree to
these terms of sale before you place an order for products or services
provided by General Diagnostic.
(2) Interpretation
In these terms of sale, "we"
means [General Diagnostic] (and "us" and "our" will
be construed accordingly); and "you" means our customer or potential
customer for products (and "your" will be construed accordingly).
(3) Order process
The advertising of products on our website
or company literature constitutes an "invitation to treat";
and your order for products constitutes a contractual offer. No contract
will come into force between you and us unless and until we accept your
order in accordance with the procedure detailed below.
In order to enter into a contract to purchase
products from us, you will need to take the following steps:
(i) Provide a written or electronic confirmation of your order.
(ii) Once we have checked whether we are able to meet your order, we will
either send you an order confirmation or invoice (at which point your
order will become a binding contract) or we will confirm by telephone
or email that we are unable to meet your order.
We will not file a copy of these terms
of sale specifically in relation to your order. We may update the version
of these terms of sale on our website from time to time, and we do not
guarantee that the version you have agreed to will remain accessible.
We therefore recommend that you download, print and retain a copy of these
terms of sale for your records.
The only language in which we provide these
terms of sale is English.
(4) The products
Will be those specified in either our quotation
or our invoice including taxes & delivery costs where appropriate.
(5) Price and payment
Payment can be made in GB Pounds stirling
by any of the following methods:
" BACS Transfer direct to our Bank
Account.
" A valid Personal/Company Cheque.
" A valid Bankers Draft.
" Cash (Send by registered surface mail).
(6) Delivery
DAMAGE OR LOSS IN TRANSIT.
No claim for damage or loss in transit can be accepted unless the following
instructions are strictly complied with:-
" DAMAGE: Any damage must be notified in writing to the CARRIERS
and ourselves within three days of receipt, and the goods must be retained
by you until examined by the CARRIERS' representatives.
" LOSS: Non-delivery of goods must be notified in writing to us within
10 days of the date of despatch.
" PRICE : Any dispute of the amounts invoiced must be notified within
10 days of the date of invoice.
" TERMS: Only Appointed credit accounts bare a maximum 30 days payment
from date of invoice.
Trademarks & Copyright
Permitted Use of GENERAL DIAGNOSTIC Trademarks
GENERAL DIAGNOSTIC trademarks identify our products, and let the public
know the source of those products. You may make fair use of our trademarks
in advertising and promotional materials, and in referring to our products
and services (for example, in a magazine article) without our permission,
provided you follow standard trademark usage practices and provide proper
attribution. Other uses require written permission from General Diagnostic.
Please make such requests by email. We will evaluate your request as soon
as possible.
In addition, you may not use GENERAL DIAGNOSTIC trademarks, whether design
or word marks, in the following ways:
In a non-GENERAL DIAGNOSTIC product name or publication title.
In, as, or as part of your own trademarks.
To identify products or services that are not GENERAL DIAGNOSTIC's.
In a manner likely to cause confusion.
In a manner that implies inaccurately that we sponsor, endorse, or are
otherwise connected with your own activities, products, and services.
In a manner that disparages GENERAL DIAGNOSTIC.
Proper Attribution of GENERAL DIAGNOSTIC Trademarks
When you use GENERAL DIAGNOSTIC trademarks, please include the following
brief statement attributing the trademarks to GENERAL DIAGNOSTIC:
"GENERAL DIAGNOSTIC & LH series Gas Analysers are trademarks
of GENERAL DIAGNOSTIC in the United Kingdom & other countries."
Use of Copyrighted Materials and Logos
Personal Use of GENERAL DIAGNOSTIC Web Site Documents
GENERAL DIAGNOSTIC hereby authorizes you to view, copy, download, and
print GENERAL DIAGNOSTIC documents that are available on this web site,
subject to the following conditions:
The documents may be used solely for personal, non-commercial, and informational
purposes only.
